Why Do Judges Continue This Unconstitutional Practice?

January 12, 2001

The key question that Prof. Rounds is always asked is why the judges would continue this unconstitutional practice. His response?

“If there is the slightest doubt whether this is legal or moral -- and there obviously are very serious questions -- why would they do this?

“It’s because these ‘poverty lawyers’ are a very important part of the ultra-liberal’s political process. Those lawyers are not there to help the poor with their legal problems. They are there to change society. The activist judges are acutely aware of this and they will do almost anything to keep them there.

“Those judges who are ‘activists’ and ultra-liberal believe they will always be in power. Therefore, they establish systems that are unconstitutional because they believe they can have a short-term gain. It doesn’t occur to them that the power will shift to a more moderate political base at some point in time.

“The money is being used to fund a group of lawyers who are working the same political agenda that the judges are. Therefore, they are loath to stop.”
