Massachusetts News Has Lost Its "Freedom of Speech"

August 2--A member of the Massachusetts Commission Against Discrimination, Douglas P. Schwartz,  spoke at the rally against J. Edward Pawlick in Newton on May 20. 

The rally was sponsored by the City of Newton and the staff of Gov. Cellucci. 

As a member of the MCAD, Schwartz is one of the people who judges whether a business has "discriminated" against a black, woman or other minority. He also determines whether a business has "discriminated" against a homosexual. If he finds that the business has "discriminated," he can require it to pay thousands of dollars in compensation plus other penalties. 

"This man is a judge," commented Pawlick. "If any suit is ever brought against me or Massachusetts News, can we expect to receive a fair trial from a man who has already indicated his bias? 

"Although a decision made by him or the full commission is appealable to a court, no one has the time or money to spend reporting to him and preparing all the paperwork that is required. Any sane businessman must do what Comm. Schwartz says and 'move on.' The right to appeal is a theory that does not exist in the real world." 

A Massachusetts business is subject to the law if it has more than five employees. 

"This means we can never have more than five employees at Massachusetts 
News or Comm. Schwartz will be on our back. He has already revealed his 
prejudice. We, and the other media, have lost our freedom of speech, but 
no one seems to realize it or to care. 

"Our employment lawyer who is eminently qualified told me, 'You're a sitting duck.'"
