Making a Further Attempt to Expand Gay Marriage to All Fifty States
The four “gay marriage” judges on the Supreme Judicial Court are seeking to expand their ruling to every state in the Union. Not being content with tearing up the Massachusetts constitution with their same-sex marriage ruling last year, the SJC is now going to hear arguments to overturn the 1913 law that prevents same-sex couples from marrying here. Gay and Lesbian Advocates and Defenders (GLAD), the same group that successfully argued the Goodridge case, will be allowed to present oral arguments in the challenge later this year. The case, Cote-Whitacre vs. Department of Public Health, is a consolidated version of suits brought by eight out-of-state couples and 13 municipal clerks shortly after gay marriages began here on May 17, 2004. In January 2005, a Florida couple married in Provincetown last summer attempted to get the state of Florida to recognize their marriage. The Florida Supreme Court cited their state’s DOMA laws and refused to recognize their marriage. (See MassNews Story Here) If GLAD is successful, it will open the door for couples from all over the United States to marry in any town in Massachusetts, then return to their state and challenge their local and state laws.
