New Marriage Amendment Might Be Destroyed by GLAD if
Margaret Marshall Is Not Removed Immediately
The homosexual law firm, GLAD,
which is a close friend of Chief Justice Margaret Marshall has announced
that it will be filing a lawsuit in January to "challenge"
the new Amendment to ban gay marriage, which has just obtained 123,356
signatures.
The law firm is the
one which obtained a 4-3 ruling in Nov. 2003 that gay marriage must
be allowed in Massachusetts. Those lawyers operate under the leadership
of Marshall's close friend, Atty. Mary Bonauto. A famous 1999 photo
shows Marshall, while dressed in her official court robes publicly promising
Bonauto at the Annual Banquet of the "Massachusetts Gay & Lesbian
Bar Association" that GLAD would win a lawsuit for gay marriage
if it were brought in this state.
Those friends of the
Chief Justice who work at GLAD are now saying our state Constitution does not allow citizens to present a petition
that seeks the "reversal of a judicial decision" such as Marshall's
ruling on gay marriage.
Attorneys are concerned
because the proposed Amendment does seek the "reversal" of
Marshall's decision.
But the much more serious
problem is that it really doesn't matter whether the lawsuit makes sense
because the one who will be deciding that question will be Margaret
Marshall and her three accomplices. Their decision cannot be easily
appealed to a federal court because this is a state issue and the highest
person in this state is Chief Justice Marshall.
Very Serious Problem
The attorneys at
Massachusetts Citizens for Marriage (MCM) tell MassNews that this creates
a serious problem for the Marriage Amendment, which is supported by
MCM as a backup if Rep. Emile Goguen's (D-Fitchburg) plan is unsuccessful
to end gay marriage immediately, this year, by removing Marshall and
the three Associate Justices who signed her Ruling.
The attorneys say that
Marshall can do anything she wishes as long as she is still in office.
They say that the political
reality is that the Catholic Church dominates the entire state with
80% of the legislators being members of the Church. The problem now
is that the Church is having internal squabbles which no one appears
able to solve. The Archdiocese of Boston is apparently going in a different
direction than Worcester, Fall River and Springfield.
Rep. Goguen, a Catholic
and a 15-year veteran in the Legislature, is applauded throughout Worcester
County by both the laity and the priests. However, he has received no
support at all from Boston. The "official" reasoning has been
that his plan doesn't stand a chance of passing, which causes most observers
to agree that it will never pass if Boston continues to oppose it for
whatever reason. Many are hoping that this will cause the two factions
to come together for the good of all.
