Margaret Marshall Strikes Again – Releasing Criminals If Not Provided a Lawyer in Seven Days
We’re seeing the first criminal defendants go free under an Order from the SJC and Judge Margaret Marshall, requiring that to happen if the state doesn’t start providing a lawyer for them within seven days. The Order was issued on July 28.
Many are wondering if that demonstrates leadership on the part of Judge Marshall. This has been a long-simmering problem for many, many years. The reality is that there are far too many lawyers in the state. There were 15,000 in 1972 and are now in excess of 70,000, largely because of the tremendous influx of women and minorities, which is fine, but instead of having them compete with others to gain admission, we have simply added them to the already overcrowded field.
Many young lawyers want to represent indigent criminals because they can pick how many hours they work while trying to build a practice. The ultimate truth is that the vast majority of these criminal defendants are guilty, everyone nows it and these lawyers are merely engaging in pointless paper-shuffling.
Lawyers Weekly points out some possible solutions this week, but the simple answer is that Judge Marshall will not come down from the mountain peak where she resides and talk to us mortals while providing leadership. She is busy working on important things, like homosexual “marriage.”body |
