Chairman, Cautioned About Finneran’s Illegal Conduct
A FedEx has been dispatched to Terry
McAuliffe, Democratic National Chairman, cautioning him about Finneran’s
illegal conduct. It noted that McAuliffe’s desire that homosexual marriage
not be an issue at the Convention is being shattered. A copy was sent
to state Chairman, Philip Johnston.
Dear Mr. McAuliffe:
You don’t want “gay marriage” to be important at the Convention here
in Boston. You said that to the Boston Globe last December.
But that’s exactly what’s happening if the Democratic leadership in
our legislature gets its way. I am attorney for Massachusetts Citizens
for Marriage.
As you may know, our Chief Justice, Margaret Marshall, is now charged
with assuring the attorney for the plaintiffs in the Goodridge case, Mary Bonauto, that she would
win if the case were brought in our courts. Marshall made the assurance
at a public meeting which was recorded. There’s no way that Marshall
can wiggle out of this.
She has been charged in separate Resolutions by two members of the House,
Rep. Emile Goguen (D-Fitchburg) and Philip Travis (D-Rehoboth). They
both seek to “Remove” (not impeach) her under a provision in our state
Constitution written by John Adams in 1780.
Yet the House leadership under Tom Finneran is trying to sweep this
under the rug by not voting on the Resolutions. This scandal is not
sweepable. This is 2002 all over again when the Democratic legislature
violated our state Constitution and refused to vote on the Protection
of Marriage Amendment, which was sponsored by my client and would have
forbad both gay marriage and civil unions.
That decision in 2002 was a terrible mistake. It made Mitt Romney our
Governor and sent Senate President Tom Birmingham and Shannon O’Brien
to the political graveyard.
They seem determined to repeat it this year. They are refusing
to allow a vote in the House, as required by the Constitution, on the
Resolutions by Reps. Goguen and Travis.
We have no desire to fight the national Democratic Party, but this state
not going to sit quietly by as we did in 2002 and watch the state Party
make a mockery of our Constitution. If they violate the Constitution
again, the aroused citizenry will make gay marriage a paramount issue
in Boston during the Convention.
I should also tell you this will be very bad for John Kerry. He told
Tim Russert in 2002 that the Massachusetts legislature should vote on
our Marriage Amendment. But when they didn’t, he showed no leadership
and allowed the legislature to get away with it. If he stays silent
in 2004 when they attempt another time to violate the Constitution,
we guarantee that everyone will know about it.
