Senate Won’t Report Vote of Members on Repealing 1913 Law The Massachusetts Senate says it didn’t keep a record of the vote of its members on repealing the 1913 law that forbids marriage being performed for out-of-staters. The Article 8 Alliance reports the following: “On Wednesday, the Massachusetts Senate voted to 28-3 (out of 40 members) to repeal a law (shown below) that prohibits marriages in Massachusetts from being granted to out-of-state residents if that marriage would be illegal in their home state. This law as it stands is perfectly sensible, and doesn't need to be repealed. The problem is that homosexual activists hate it, because it keeps all out-of-state homosexuals from having a "marriage" granted here in Massachusetts. So, as usual, our elected officials are caving in to their whims, rather than standing on principle. (Luckily, we're told it has little chance of getting through the House.) “We called up the Senate Clerk to get the list of Senators who voted for, and against. (Remember, it was 28-3.) Guess what? They won't tell us. We're being told that for this vote the members stood up, and were hand counted, but nobody wrote down their names. “Homosexual activists are telling legislators that the 1913 law needs to be repealed because it was originally passed to help enforce laws in other states prohibiting blacks and whites from marrying. In fact, that's pure nonsense. Massachusetts historically did just the opposite. For example, Massachusetts refused to enforce the Dred Scott decision, and removed a judge who attempted to enforce it. But in any case, the law makes sense to anyone but a radical homosexual activist. “The full text of the law is: Chapter 207: Section 11. No marriage shall be contracted in this commonwealth by a party residing and intending to continue to reside in another jurisdiction if such marriage would be void if contracted in such other jurisdiction, and every marriage contracted in this commonwealth in violation hereof shall be null and void.”
